1. Who we are

This website, orinocostudios.org, is operated by Orinoco Studios OÜ, a company registered in Estonia. You can reach us at hi@orinocostudios.dev.

2. What these terms cover — and what they do not

These terms govern your use of this website. By browsing it or sending us a message, you accept them. If you do not accept them, please do not use the site.

These terms are not a contract for our services. If we work together, that engagement is governed by a separate written agreement covering scope, deliverables, timelines, fees, intellectual property in the work produced, confidentiality and termination. Nothing on this website replaces or overrides that agreement, and nothing here creates one.

3. The content of this site is not a binding offer

The descriptions of services, capabilities and approaches on this site are provided for information. They are not an offer in the legal sense, not a quotation, and not a commitment to deliver any particular outcome, scope or timeline. Any actual proposal we make will be given to you in writing and identified as such.

We try to keep the site accurate and current, but we do not warrant that it is free of errors or omissions, and we may change its content at any time without notice.

4. Using the site

You may read this site, and contact us through it, for any lawful purpose. You may not:

• use it in any way that breaks the law or infringes anyone else's rights;
• attempt to gain unauthorised access to the site, the server it runs on, or any connected system;
• interfere with its normal operation — including automated flooding of the contact form, denial-of-service attempts, or circumventing rate limits or anti-abuse measures;
• send us content through the contact form that is unlawful, defamatory, or that you do not have the right to send;
• harvest personal data from the site, or use it to send unsolicited commercial messages.

We may restrict or block access if we reasonably believe the site is being used in breach of these terms.

5. Messages you send us

When you send a message through the contact form, you confirm that the information you give is accurate and that you are entitled to share it. Please do not send confidential or sensitive information through the form — use it to start a conversation, and we will agree a secure channel and, where appropriate, a confidentiality agreement before anything sensitive is exchanged.

Receiving your message does not oblige us to reply, to quote, or to take on the work. How we handle the personal data in your message is described in our Privacy Policy.

6. How we use artificial intelligence

We use artificial intelligence tools as part of how we work: coding assistants, language models — including models we run on our own infrastructure — and image and video generators. They help us write and review code, prepare documentation, draft communications (including replies to messages we receive through this site) and produce graphic and audiovisual material. Everything we deliver or publish is reviewed by a person, and responsibility for our work always remains ours, not the tool's.

If we publish AI-generated images, audio or video that could be mistaken for real people, events or places, we will label it visibly.

When a project includes an AI system that interacts with people — a chatbot, for example — we design it so that its users know they are interacting with AI, as required by Regulation (EU) 2024/1689 (the AI Act). How responsibility for that system is shared is set out in the engagement agreement described in section 2.

This website itself contains no chatbot or user-facing AI system, and no automated decisions are made about you. How these tools affect your personal data is explained in our Privacy Policy.

7. Intellectual property

The content of this site — text, layout, graphics, logos and the Orinoco Studios OÜ name — belongs to us or is used with permission, and is protected by intellectual property law. You may read it, and share links to it. You may not copy, republish or adapt substantial parts of it for commercial purposes without our written permission.

This says nothing about intellectual property in work we produce for a client. That is dealt with in the engagement agreement described in section 2.

8. Links and third-party services

This site links to third-party websites and loads resources from third-party providers, as described in our Privacy Policy. We do not control those third parties and are not responsible for their content, availability or practices. A link is not an endorsement.

9. Availability

We aim to keep the site available, but we do not guarantee uninterrupted or error-free access. We may suspend, withdraw or restrict all or part of it for maintenance or for business reasons, without notice and without liability.

10. Liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data arising from your use of, or inability to use, this website.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intent or gross negligence, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, you keep all mandatory rights under the law of your country of residence, and nothing here affects them.

11. Privacy

How we handle personal data is set out in our Privacy Policy, which forms part of these terms.

12. Governing law and disputes

These terms are governed by the law of the Republic of Estonia, and disputes arising from them fall to the courts of Estonia.

If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may also bring proceedings in the courts there. You may also be able to use an out-of-court consumer dispute resolution body in your country; we are happy to point you to the relevant one on request.

13. Changes to these terms

We may update these terms. The version published here, with the date at the top, is the one that applies. Continuing to use the site after a change means you accept the updated terms.
